Terms & Conditions
By completing the Like A Record 360 enquiry form and paying the holding deposit, the hirer or their agent is agreeing to the following terms & conditions.
Definitions
'Bond' - $1,000 to cover the total replacement cost of the Equipment.
'Booking' - confirming Equipment hire and acceptance of the Terms & Conditions through payment by the Customer.
'Content' - audio messages recorded on the Guest Book
'Customer/You./Your' - the person, company or other body which is hiring from Like A Record 360.
'Equipment' - Guest Book and associated hire items provided to the Customer, including but not limited to transport case, signage, and charging cable.
'End Date' - last day of the Hire Period
'Guest Book' - physical phone that records voice messages.
'Hire Period' - the time the Equipment is hired for, including any additional time due to late return.
'Like A Record 360' includes any employees.
'Start Date' - first day of the Hire Period
Hiring, Delivery and Return of Equipment
Delivery of the Equipment to Canberra and surrounding regions is included in the hire price of your Equipment. You will receive your Equipment at least 3 days prior to the Start Date, unless there is a delay in shipment beyond the reasonable control of Like A Record 360. Prior to confirming your booking, Like A Record 360 will confirm whether the return of the Equipment will be via drop-off/pick-up, or shipping. In the case of the latter, Like A Record 360 will provide a prepaid shipping satchel for the return of the Equipment. You will then be required to express post the Equipment within 3 days after the End Date. Futile deliveries and delayed returns may incur additional courier/hire charges.
You will receive a link to your private gallery of audio messages within 10 business days of Like A Record 360 receiving the Equipment back. You will receive .wav files for each audio message recorded on the Guest Book.
Preload Voice Message
You will be able to create a personalised voice greeting which will be preloaded into the Guest Book, included in the hire of the Equipment. You agree to send your pre-recorded greeting via email to Like A Record 360 at least 10 days prior to the Start Date, otherwise the Guest Book will be loaded with a generic greeting. The personalised voice greeting must be sent as a .wav file.
Use of Recordings
When hiring from Like A Record 360, you give permission for audio messages recorded on the Guest Book to be used on the Like A Record 360 website and for advertising purposes.
Like A Record 360 will not use any voice messages which are deemed unsuitable or inappropriate on our website or for advertising and will not use any content that we consider may be personally damaging to any person(s).
Like A Record 360 will not sell your personal details to any third party and will take all reasonable measures to ensure that your personal details remain confidential.
Due to the intellectual property held within the physical construction and software of the Guest Book, any tampering proven by built-in tamper measures or otherwise will incur a $2,000 fee.
Failure to Complete
At all times care will be taken by Like A Record 360 to ensure delivery of the booked package, however, should unforeseen equipment failure prevent this, during the normal course of events, liability will be limited to a total or partial refund of monies paid, dependant on our deliberation of the unique circumstances and/or the amount of the booking that was fulfilled successfully.
Like A Record 360 cannot be held in any way liable if equipment or accessories failure or damage (including electrical, water or other liquid damage) is due to any negligence, an act or fault on the part of any venue or venue staff or is due to any negligence, act or fault on the part of any client or client guest or other person using the Equipment at your event/function, which negligence, act or fault, wilful or accidental in turn prevented the successful completion of the agreed to Like A Record 360 service(s).
Delays
Like A Record 360 cannot be held responsible for unforeseen delays of delivery of the Equipment which are out of our control.
Force Majeure
Like A Record 360 will not be liable for failing to perform under the agreement by the occurrence of any event beyond our reasonable control, including a labour disturbance, fire, threatened or actual act of terrorism, natural disaster, extreme weather events (including but not limited to flooding, cyclones, earthquakes, which events might prevent the videobooth attendants from attending the venue or to perform his/her duties whilst at the venue), or war. Like A Record 360 will not be held liable for failure to attend a booked event or complete a booked event in the event of closure of the venue prior to or during a booked event or cancellation of a booked event by the venue or by cancellation of a booked event or closure of the venue by other parties or Government authorities, representatives or bodies.
Payments
A 30% deposit payment is required from the hirer or their agent, within 7 days of receipt of an invoice from Like A Record 360. The remaining balance will be payable by the hirer or their agent at least 14 days before the booked date, unless otherwise agreed to in writing by both parties.
Security Statement
Our banking details for direct deposit will be noted on your invoice and should not change at any time. If you receive any emails purporting to represent Like A Record 360, listing changes to our banking details, please contact Like A Record 360 by phone before making any payments. We will not be held liable for payments made to the wrong location.
Cancellation
If you cancel your booking 21 days or more prior to the Start Date, you will forfeit the 30% deposit. If you cancel your booking between 11 and 20 days prior to your Start Date, you will receive a 50% refund. If you cancel your booking within 10 days or less of your Start Date, no refund will be provided.
Postponement
If a client wishes to change the Hire Period, it will be at the discretion of the Like A Record 360 management staff as to whether this is a viable option. In most cases a postponement can be arranged, however if the management deems the postponement unviable, the booking will be deemed a cancellation and the above cancellation terms will apply.
Liability for Damages
Maximum damages - you agree that the maximum amount of damages you are entitled to in any claim relating to the hire of the Equipment is limited to the total cost of your booking.
Issues with Equipment - you agree to notify Like A Record 360 within 12 hours of your Equipment being delivered of any issue (including, but not limited to damage, non-working function or incorrect preloaded voice greeting). Like A Record 360 will work to get the Equipment fixed/replaced no later than your Start Date at no cost to you if notified within the requisite timeframe. Failure to notify within this period will result in a waiver of this right.
Loss and damage of Equipment - you agree to bear the entire risk of loss and damage to the Equipment from any and every cause whatsoever during your Hire Period. In the event of damage to the Equipment, we may retain the Bond. You agree to return the Equipment clean. Should the Equipment be deemed dirty, we reserve the right to retain $50 of the Bond as a cleaning fee. A reasonable level of wear and tear to the Equipment through normal use is accepted and is at the sole discretion of Like A Record 360. You agree to not attempt to repair or materially alter the physical or otherwise makeup of the Guest Book without prior consent of Like A Record 360.
Removal of Content
You agree to not attempt to remove content from the Guest Book.
Loss of Content
In the (unlikely) event that content is lost or damaged for reasons not related to actions taken by you or your guests, we will provide you with a full refund.
